Supplementary Protection Certificates (SPCs) extend the protection of a pharmaceutical patent for a period of maximum 5 years. This reason for the protection of SPCs is the very long approval procedure, which results to the delayed distribution of pharmaceuticals in the market. In Greece, Supplementary Protection Certificates are granted by the Industrial Property Organization (OBI). The Greek Industrial Property Organization does not examine whether a Supplementary Protection Certificate already exists for this product, or whether the submitted approval for licensing really is the first approval for the marketing of the product in Greece. Therefore, an SPC may be granted by the Greek Industrial Property Organization even though the requirements for protection are not fulfilled.
